BUYER BEWARE! When dealing with Robert Hernandez of rareelcos on eBay!


I recently bought a set of aluminum brake drums from him on ebay. Paid something like $65 + $12 shipping. After a few weeks I get this busted up box with one drum. I waited a few days thinking he shipped each one seperately. I emailed him to ask and after a day or two he responded telling me they were both in the same the same box. When I complained that I only received one, his response was "something sounds fishy, how could he put 2 in the box and I only get one?" Like I'm a theif! Maybe if this guy packed them in a better, stronger box they may have survived the trip from california to ny. So I sent him pics of the resealed broken box and so far after 3-4 days he hasn't answered me. So $75 later I have one drum.
He thinks its my fault?! How could that be? I paid what he asked and he packed and shipped. I have no control over how he packs or ships and he offers no insurance.
The screwed up thing is this guy has just about any elco/malibu part you could want, but he doesn't care what happens after he has your $$$!
Best advice is buy from him only if you really can't find it elswhere and only pay what you can afford to lose because he won't accept any responsibility when a problem arrises.

Can you still work with the vendor? Did you pay via PayPal?, because you might have some recourse via them.

The last resort is fry the vendor via feedback but if possible try working with them first.

Go by the weight. I assume it shipped UPS or other ground shipment? What is the weight on the shipping label? What is the weight of the actual received shipment? If they are the same then he only sent one and knew it, if the weight on the label is considerably more than the actual weight then one really did sprout legs. If one is trully missing then you may have a claim with the shipping company as most insure up to $100 at no charge.

Also, in the future, if asked to sign for a shipment and the box is broken or appears tampered with then always sign it "package subject to inspection"' or "shipment damaged, subject to inspection."

Cool If the weight on the label is for two that means the box most likely got damaged in transit and the part lost. The shipper reseald the box and sent it on. He is then responsible for the missing contents. BUT!, if you signed for it without inspecting the contents and the driver left you are stuck! I know this from personal experience. I now open the package and inspect the contents before signing. The driver will sometimes get a little irritated but so what! It's my money on the line not his. One even tried to refuse to hand me the package until I signed (Fed-Ex) well after an short argument I placed a call and got his supervisor on the line and read him the riot act after which he asked to talk to the driver who then promptly apologised and haned me the pacage to inspect! Cool

Well if you ship USPS insurance is an add-on at extra cost. The postage on the box is about $26. He charged me $12 for shipping. The package was tossed over my locked gate onto the lawn. No one signed for anything. Yeah there probably were 2 in the box, but the box is a very thin cardboard that the fins on the drums would easy cut through. Again, I have no control over how he ships. USPS doesn't cover anything unless insurance was purchased at the time of shipping and he refuses to do so.
As for trying to work something out with him, he blew me off with his something sounds fishy reply and ignores any further emails. I'm sure he couldn't care less about negative feedback.

Well since you know his zip code and yours, the type of USPS shipping, and you know the postage amount it's easy to back figure the original weight. Just go to the USPS web site and enter both codes and the present weight. If it amounts to $26 then you know he sent one, if less then double the weight and see what it amounts to.

If he did ship both then you don't have much recourse except possibly to file a complaint with PayPal that the package was so poorly packaged it fell apart. I doubt you'll get much results though.

Always demand insurance, if the seller refuses I'd be suspicious.

screw all that... The longer you weight the less recourse you have. I had a problem with eBay when I first started... and I lost about 300 on the deal. NEVER AGAIN!!! I almost was had again recently but I paid with a credit card so when I received an incomplete package I called my card company and filed a claim for $770. They immediately filed a dispute with pay pal and gave me back my money as a credit. You should then take pictures of the horrible packaging as evidence and do as everyone else has said, go to USPS and see how much the weights cost to ship and you can use that as evidence too. For a claim so small they might just give you back the 75. thats my .02 $.

If you paid VIA paypal you are protected by paypal. If you accept payment VIA paypal you are required to insure the package.

Paypal is very buyer freindly but very seller unfreindly as they almost always take the side of the buyer before ever contacting the seller.

This discussion is interesting and has me wondering.On several occasions UPS,Fedex etc. have left packages on my doorstep and left before I could get to the front door.If a question arises am I at a disadvantage in seeking remedy? I have ordered from rareelco in the past and received excellent service.Please let us know the outcome of you order situation.

While we're on the subject; I bought over $330 worth of parts from Dixie Monte Carlo Depot a couple months ago, thier policy is "free shipping on any order over $300". But the headliner I ordered was shipped oversized. The online order reciept didn't mention any additional shipping, and neither did thier email confirmation. But almost a week later my credit card was charged over $50 more than the reciept stated. When I called they told me there was an additional charge for the oversized container (headliner).

I don't dispute thier right to charge for oversized shipping, but thier "receipt" should reflect the correct amount BEFORE they withdraw any money from my account.

I will never order anything from them again online (if I do at all). I would only deal with them by phone. With the technology available today there is no reason to omit shipping charges on any order. Every other vendor I have ordered parts from online has included "extra" shipping charges at the time I placed the order, before confirming my purchase.

When I called there was no "Sorry for the confusion", just silence when I asked for an explaination. And my email went unanswered.

I've got a premier account with Paypal but have never been under any obligation to insure anything. I give the buyer that option on Ebay and they can pay for it. Now I do ship UPS or Fedex which gives me a certain amount of automatic insurance but that's it. USPS is useless for insurance claims and their tracking is horrible, I don't like using them because of that.

I usually insure packages anyway but Paypal has never made that kind of requirement of me on any of my Ebay Sales.

If the seller isn't willing to do anything about it, file the complait through payapal. Make sure you get to it within their time limit though. I've missed out on being able to file a complaint because I was trying to work the problem out with the vendor. Couldn't even leave feedback for them by that point.

Paypal takes a while to go through their claims, but I've gotten eventually my money back anytime I've had a claim.

I thought I recognized the name Robert Hernandez and rareelcos. This is the guy that showed 5 headliner trim clips in his ad and only sent me three. He responded to me saying it would work just fine with three and he shows the extras so that customers can see what the product looks like better. There are five holes in the ceiling and there were five clips on the piece I removed. I did not leave him any feedback because the few times I did that with other sellers, I got bad feedback in return. What a piece of crap he is.

Now I feel bad I did not complain.

Don't worry about negative feedback on Ebay now. Sellers can't leave negative feedback since the new rules went into effect.

All a seller can do is file a complaint for a non-paying bidder.

Ebay is a buyer's paradise now and is openly hostile to sellers, even the honest ones.

I dread putting anything up there now because of the BS they pull.

But again, the point is, feel free to give this guy the works if he deserves it because Ebay has your back.

....whether you need it or not...

I hate Ebay....

Nothing personal on you I just hate the BS going on over there now. They are chasing away honest sellers and allowing bad buyers to get away with murder...
