Deed Restricted Homeowner Rejoice!

I live in a deed restricted community in Florida and have had my share of runins with what I call the communazi's of the homeowners association. You know the people with to much time on their hand looking over the fences and in your yards for violations of our by-laws ie having a truck on your driveway during the day. No less a beautiful classic El Camino included in this discription at least by the state of Fla DMV registration.

Well today I open my mailbox to find a envelope marked " Fellow El Camino Owner" to my suprise I find a hand written note" FYI!! Smile

call me if you have any questions and his number along with a FINAL JUDGMENT for th County Court of Manatee County Florida Case No. 2003-CC3260 finding the defendants Chevrolet El Camino motor vehicle is a "non commercial private automobile" and not a "truck" as defined by plaintiffs (homeowners association). I looked up the case and it dragged out 16 monthes thru the courts. I called them and we had a great conversation they have a 1977 Elky thats be restored and are now going to join NECOA. They were happy to make my day and parked their Elky on the driveway. Mine sleeps inside but it's good to know I can if I need to park on my owe driveway. Hope this helps anyone else dealing with these kind of moronic people in their neck of the woods or deed restricted communities.

That is one of the most IGNORANT things I've ever heard...I can't believe that someone(probably some senile,self-righteous, blue-haired, quilt-knitting bingo-addicted frigid widower) would even ATTEMPT to ban your elky from the driveway, let alone try to enforce such a rule. I don't live in a controlled community,and our "hood" shows just fine...and we have hot rodders/classic car owners (who park in the driveway) up AND down our block! Covanents do at times serve a asthetic purpose..... I could see them harping over a semi-tractor-trailer rig or a un-tagged half-gone parts car,something like that... but a legally insured and plated, clearly non-commercial personal vehicle in operating condition?? PFFFFT! Too bad you can't sue THEM for harassment, frivolous claims or SOMETHING... Geez!

Mama....If your in Denver,you can come park your rig in front of our place anytime if you need...if the neighbors beef over it, they'd better be ready to BOX! (My pops is STILL driving semis for a living....raised 5 of us...I went on a trip or two as a lad....he's hauled everything from freight to swinging meat to haz-mat since I was born.... for as long as I can remember.... and I'm 42!)

Hey Mama Iam with you,the property taxes I pay I should be able to park anything thats ''roadworthy'' on my land....I had a Pete that cost almost as much as my neighbors house, but if I stopped by the my house to have lunch or pick-up something----knock-knock HEREEEEE'S YOUR TICKET. now I wonder how they knew? Oh well love your nieghbor,and remember IF YOU GOT IT A TRUCK BROUGHT IT.

I have always fought and defended my right as a home owner to do as I please with my property. I still don't see, if you own your land how you cannot park certain vehicles on it and have certain things on your property. My neighbors from a few houses away on another street, whine (my Immediate neighbors are the greatest) when I burn a few sticks in my back yard, The Fire Department has been called on more that one occasion for a small thin trail of smoke to 7-10 foot flames (yeah I do it right) and the claim that they can't handle the smoke smell in their house WELL CLOSE YOUR F'N WINDOWS!! My Dad used to burn grass when we were kids and I have come to like the smell. I live in a small town(orig from Indy) and have an acre of land,... This is MY house and MY property. I and I alone am paying $80,000+ for my home and property and I don't see how someone who lives a few houses away can dictate what I do on my own land when they are more than likely renting. State and City laws should lean toward the homeowner vs the renter. Nothing against the renter, I too have rented for a long time before buying this house, but when you are paying several Thousand dollars for your Piece of the world you should have that considered too, and be given a little leniency for it as well.

Just my .02 on these home owner battles.

WOW, you all would really love the small city that I live in. My neighbors are just as nice as can be, with no complaints so far. There are trucks parked on the street and in driveways all over town. There aren't any Elkies in town yet, but I will get one again soon.
There are a few places on the market, come take a look!! But we do have our share of snow, salt and gravel. Crying

I live in a HOA (Home Owners Association) community too. A former Resident Board Member lived across the street and she was pretty cool about stuff. I had been warned to remove my son's truck "a non-working vehicle" because he did not drive it for a few days. He had already sold it and it was removed the day notice arrived. Two doors down from me had a Semi tractor parked in her driveway for over a month. She never got a letter. Her neighbor had a class A motorhome in his driveway for two weeks while his parents visited from Florida. He got a letter I was told but ignored it and his parents left before it escalated. Both were obvious violations in the 50 or so pages of the Covenants.

Most covenant violations are enforced on a "Who Likes You Basis"

So o o o o o Pick your favorite
1) Get your neighbors to like you
2) Have all your neighbors owe you favors
3) Make all your neighbors fear you
4) Move out to the country
5) Follow the rules
6) Don't get caught

This thread hit home because my annual HOA meeting is next week. A guy was seen video taping around the neighborhood this week so I might get nicked for the oil spots on the driveway. Illegal driveway boarders. Dead plants. Non-color co-ordinate "spinners" hanging on the front porch. Shed the wrong color and 2" too tall. Dead tree in the backyard. Grass not all the same height.

Nothing will happen. I go by #2 above. Plus I got a cool '81 in my driveway.

If you live in Fla in a homeowner's association controlled by Fla. Stat. 720 the best thing to do is get very familiar with your governing documents. Also if someone is causing you problems best thing to do is get on the board of directors. As to whether our El Caminos are prohibited trucks or not the best thing to do is file a lawsuit against whoever thinks it's a truck and ask the Court to issue a declaratory judgment purusuant to Fla Stat. 80 (I think that's the right#). In these type of cases usually the Court awards attorney fees to the prevailing party. After you whip their butts a few times and they have to pay for it they'll get the idea and quit bothering you. Also it's a good idea to keep your eye on federal rules particularly coming out of HUD. Remember the interpretation following the 1996 Federal Telecommunications Act by the FCC saying that the prohibition on satellite dishes was essentially unenforceable in a HOA environment. These federal rules can preempt HOA rules. I'm in an HOA and when the lady accross the street objected to me about working on the El Camino in the driveway on Saturday afternoons I told her that her 100 pound dog violated the pet size rule but that it wouldn't bother me so long as my El Camino didn't bother her anymore. Now we're best friends! Imagine that. Good luck with the condo commanders. There are over 25,000 associations in Fla if you can believe that.
